Non-competes are banned in 5 states and the District of Columbia, and unenforceable for most workers in a dozen more.

The FTC attempted a near-total ban on non-competes — struck down in federal court. But states have been moving fast on their own, and the map is dramatically different from even 5 years ago. California, Minnesota, Montana, North Dakota, and Oklahoma ban non-competes entirely. The District of Columbia bans them for workers earning under $150,000/year (the highest threshold in the country). Colorado, Illinois, Maine, Oregon, Rhode Island, Virginia, and Washington have salary thresholds below which they're unenforceable. Before you ask anyone to sign one, know what your state actually allows.
